Terms of Service

Terms governing the use of the THB platform and services. Last updated February 2026.

Acceptance of Terms

By accessing or using the THB platform, website, or services, you agree to be bound by these Terms of Service. If you are using the services on behalf of an organization, you represent that you have the authority to bind that organization to these terms.

Description of Services

THB provides an AI-native healthcare data cloud platform comprising DataCloud (data engineering), NovaHub (API gateway), PEP (marketing automation), and CRM Suite (operational CRM). Services include data processing, clinical intelligence computation, patient engagement automation, and analytics. Specific service features and availability are defined in individual service agreements.

Account Responsibilities

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify THB immediately of any unauthorized use of your account. THB is not liable for any loss arising from unauthorized use of your account.

Acceptable Use

You agree to use THB services only for lawful purposes and in accordance with these terms. You may not use the services to process data without appropriate legal basis, attempt to access other users' data, reverse engineer the platform, or engage in any activity that interferes with the services. Healthcare data must be processed in compliance with applicable regulations.

Data Ownership

You retain ownership of all data you submit to the THB platform. THB does not claim ownership of your data. We process your data solely to provide the contracted services. De-identified and aggregated data may be used to improve our services, subject to applicable data protection requirements and consent frameworks.

Service Level & Availability

THB strives to maintain high availability of all services. Specific uptime commitments and support response times are defined in individual service level agreements (SLAs). Planned maintenance windows will be communicated in advance. THB is not liable for service interruptions caused by factors outside our reasonable control.

Intellectual Property

The THB platform, including its software, algorithms, designs, and documentation, is the intellectual property of THB. Your use of the services does not grant you any ownership rights in the platform. Configuration files, custom workflows, and data you create using the platform remain your property.

Confidentiality

Both parties agree to maintain the confidentiality of information designated as confidential. This includes technical architecture details, business metrics, pricing, and any patient or clinical data. Confidentiality obligations survive termination of the agreement.

Limitation of Liability

To the maximum extent permitted by law, THB's total liability for any claims arising from or related to these terms or the services shall not exceed the fees paid by you in the twelve months preceding the claim. THB is not liable for indirect, incidental, special, consequential, or punitive damages.

Termination

Either party may terminate the service agreement with written notice as specified in the individual service agreement. Upon termination, THB will provide a reasonable period for data export. After the export period, your data will be securely deleted in accordance with our data retention policies.

Governing Law

These terms are governed by the laws of India. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts in Bangalore, India.

Changes to Terms

THB may update these terms from time to time. Material changes will be communicated through the platform or via email. Continued use of the services after changes constitutes acceptance of the updated terms.
